1. Our Services

EMG DISTRIBUTION LLC provides business logistics services, including packing and kitting, shipping management, warehousing and storage, and e-commerce order fulfillment. Descriptions on the Website are general in nature and are provided to help you understand what we offer. The specific scope, service levels, rates and responsibilities for any client are set out in a written quote and a signed service agreement.

2. Quotes and Service Agreements

• Submitting a quote request does not create a contract or obligate either party to provide or purchase services.
• Quotes are prepared from the information you provide. If actual product dimensions, volumes or handling needs differ, the quote may be revised.
• Unless stated otherwise, written quotes are valid for 30 days from the date they are issued.
• Services begin only after you accept a quote and sign a service agreement. If the service agreement conflicts with these Terms, the service agreement controls.

3. Client Responsibilities

Clients are responsible for:

• Providing accurate product information, including descriptions, weights, dimensions, quantities and any special handling requirements;
• Ensuring that goods are lawful, properly labeled and permitted to be stored and shipped;
• Providing complete and correct recipient and order information;
• Paying invoices according to the payment terms in the service agreement.

4. Prohibited Goods

We do not accept, store or ship the following items:

• Hazardous materials, explosives, flammable or corrosive substances, unless expressly approved in writing and compliant with carrier and federal regulations;
• Firearms, ammunition, weapons and weapon parts;
• Illegal drugs, controlled substances, counterfeit or infringing goods, or any goods prohibited by law;
• Live animals and perishable goods requiring temperature-controlled storage;
• Cash, precious metals, securities or other items of extraordinary value.

We may refuse or return any shipment that we reasonably believe violates these restrictions.

5. Shipping and Carriers

Shipments are transported by third-party parcel and freight carriers. Transit times shown in quotes or on the Website are estimates provided by carriers and are not guaranteed by us. Carrier liability for loss or damage is governed by the carrier's own terms and limits. Additional declared value coverage may be purchased per shipment when available.

6. Limitation of Liability

To the fullest extent permitted by law, EMG DISTRIBUTION LLC is not liable for indirect, incidental, consequential or special damages, including lost profits or lost sales, arising from the use of the Website or our services. Our liability for goods in our care is limited as set out in the client's service agreement. Clients are encouraged to maintain their own insurance for the full value of goods stored or shipped.

We are not responsible for delays or failures caused by events beyond our reasonable control, including severe weather, hurricanes, natural disasters, carrier disruptions, labor actions, government actions or utility failures.

7. Use of the Website

You agree not to misuse the Website, including by submitting false information, attempting to gain unauthorized access, interfering with its operation, or sending automated or unsolicited requests. All Website content, including text, graphics, logos and layout, belongs to EMG DISTRIBUTION LLC or its licensors and may not be copied or reused without permission.
